Medicare Exclusion Action Successfully Defended

Parker Eastin, Partner at Nicholson & Eastin LLP, persuaded the Centers for Medicare and Medicaid Services to close their investigation into and attempts at implementing a Medicare exclusion of a provider following a federal criminal conviction. Mr. Eastin successfully argued that the conviction was unrelated to the provider’s practice of medicine, and that the criminal conviction was only a moment in time in an otherwise unblemished career and exemplary professional life. In doing so, the client was able to avoid repercussions by the Florida Board of Medicine, such as revocation of the providers medical license which is required upon exclusion from the Medicare program.
