Previously Excluded Health Care Provider Reinstated to Medicare Program

After having been convicted a decade ago in a Medicare kickback case, and being subsequently excluded from participation in the Medicare Program, the health care provider engaged Nicholson & Eastin, LLP to assist him with seeking reinstatement to the Medicare Program. Reinstatement as a Medicare provider after exclusion is not automatic, and can in many cases be quite difficult.

Firm attorney Parker Eastin worked with the provider to develop a compelling case that the provider should be reinstated, focusing on the provider’s very minor role in the prior kickback case, the provider’s lack of legal entanglements in the intervening decade, and the positive work the provider wanted to do going forward. HHS ultimately agreed with the request and reinstated the provider to the Medicare Program effective upon the receipt of the letter.
