Revocation of Medicare Billing Privileges Reversed

Based upon a reconsideration appeal prepared by the Firm on behalf of a revoked physician provider, First Coast Services Options reversed the revocation of the physician’s Medicare billing privileges. Following an almost yearlong investigation by SafeGuard Services and CMS, the Medicare billing privileges of the physician were revoked. The Firm reviewed the basis for the revocation and submitted a reconsideration appeal. The appeal established that the physician had been fully engaged and cooperative with SafeGuard Services and CMS regarding their investigations, including the production of requested records, which rebutted the alleged basis for the revocation. Attorney Erin Ferber further argued the revocation was improper because SafeGuard Services failed to follow-up with the physician regarding alleged deficiencies in the records production, which it should have done in light of the investigations. The physician’s Medicare billing privileges were reinstated retroactive to the date of the improper revocation.
